Terms of Service
1. BizSoKae as an Intermediary
BizSoKae acts strictly as an "Intermediary" under the Information Technology Act. We provide a marketplace platform for Independent Freelancers and Business Owners to connect and collaborate. We are not a party to any service contracts between users unless they specifically opt for the "BizSoKae Shield" Escrow service. BizSoKae does not exert control over the work product or fulfillment of duties by users.
2. Eligibility
The Platform is available exclusively to Indian residents with a valid mobile number beginning with +91. All users must complete KYC verification (PAN/Aadhaar for freelancers, GST/MSME for businesses) before accessing core features.
3. User Roles & Accounts
The Platform operates under three roles: Freelancer, Business Owner, and Administrator. Each role carries specific rights and responsibilities. Accounts are non-transferable. You are responsible for maintaining the security of your credentials.
4. Coin Economy & Bidding
BizSoKae operates a coin-based economy. Submitting a bid on a project costs 20 coins. Profile promotion costs 100 coins for a 24-hour boost. Coins earned through approved blogs (+30) and subscriptions (+100) are non-refundable and non-transferable between accounts.
5. Marketplace Rules
A maximum of 5 freelancers may bid on any single project. Business owners may remove up to 2 bids per project. Any attempt to circumvent these limits through multiple accounts will result in permanent suspension.
6. BizSoKae Shield & Escrow
Users may choose to work "Directly" or via "BizSoKae Shield".
- Direct Projects (Unprotected): 0% Fee. Users manage payments and delivery independently. BizSoKae provides NO arbitration, NO payment guarantees, and NO dispute resolution. Users assume 100% of the financial and legal risk.
- BizSoKae Shield (Protected): Projects utilizing the platform's Escrow system incur a 5% "Trust & Safety Fee". In this mode, BizSoKae acts as a neutral arbitrator for all disputes regarding milestone delivery. Funds are subject to GST (18%) and TDS (1%).
7. Content & Blogs
Freelancers may submit blogs for review. The Admin reserves the right to approve or reject blog submissions. Approved blogs earn 30 coins. Content must be original, non-plagiarised, and must not violate any third-party intellectual property rights.
8. Ratings & Reviews
Users may rate each other only after a project has been marked as completed. Ratings of 3 stars or below require a mandatory written justification. False or malicious reviews are grounds for account suspension.
9. Prohibited Conduct
Users may not: engage in fraudulent activity, submit fake KYC documents, harass other users, use the platform for any illegal purpose, or attempt to contact parties outside the platform to bypass fees.
10. Termination
BizSoKae reserves the right to suspend or terminate any account without notice for violations of these Terms. Coin balances on suspended accounts are forfeited.
11. Limitation of Liability & Indemnification
To the maximum extent permitted by law, BizSoKae shall NOT be liable for any direct, indirect, incidental, or consequential damages arising out of user-to-user interactions. Users agree to indemnify and hold harmless BizSoKae and its directors from any legal claims, losses, or expenses resulting from project failures or breaches of contract between users.
12. Governing Law & Binding Arbitration
These Terms are governed by the laws of India. By using the platform, users agree that any disputes arising from Escrow-protected projects will be resolved through BizSoKae's internal arbitration panel, whose decision shall be final. All legal matters are subject to the exclusive jurisdiction of courts in Maharashtra, India.
